Hewlett-Packard is suing Mark Hurd, a day after his hire by Oracle.

Court documents filed Tuesday morning in Santa Clara County show HP is accusing its former CEO of breach of contract and threatened misappropriation of trade secrets.

HP released a statement Tuesday morning saying that "Mark Hurd agreed to and signed agreements designed to protect HP’s trade secrets and confidential information. HP intends to enforce those agreements."

Mr. Hurd will bring his expertise running the largest computer hardware business on the planet to Oracle, where he may be able to revive the fortunes of Sun’s products at H.P.’s expense.

Oracle has, in particular, used Sun’s technology to build a new line of data warehousing systems that can sort through huge volumes of information like sales trends, pricing and inventory levels.

HP’s worst-case scenario comes to fruition…

Oracle Corp. named Mark Hurd co-president and appointed him to its board of directors, heightening the rivalry between the software company and Hewlett-Packard Co., the technology giant Mr. Hurd ran as chief executive until departing amid a scandal last month.

The company also said that Charles Phillips, one of two co-presidents and a board member, has resigned. Mr. Phillips made headlines with his own missteps this year at Oracle. Safra Catz, Oracle’s other co-president, will remain in that role.
